Law 12/2020 Right to Access Information

Right to Access to Information Law:

Law No. 12 of 2020 regarding “The Right to Access Information” was issued emanating from international obligations and agreements as one of the international channels to enhance integrity and tackle corruption; This law aims to promote the freedom of information circulation and the right to access such information, it also enhances the principles of transparency and integrity in administrative and economic transactions also to enhance confidence in decisions issued by government entities to whom the law is addressed.

In enactment of this law, KDIPA issued it’s decision No. 70 of 2021 dated 03/03/2021 assigning the Technical Office and Governance Department to take all necessary measures to implement Law No. 12 of 2020 regarding the right to access and its executive regulation.

  • Steps to Submit Application (Personal attendance):

  1. Print and fill out the approved form to request the right to view or to obtain information and documents.
  2. Attach the supporting documents for the application and proof of interest.
  3. Personal attendance to submit the application (Al-Hamra Tower, Floor 47, Technical Office and Governance Department).
  4. The entity will deliver receipt of the submitted request.
  • Steps to Submit Application (Online):

  1. Fill out the approved form to request the right to view or to obtain information and documents.
  2. Attach the supporting documents for the application and proof of interest.
  3. Send the form via e-mail to RAI@Kdipa.gov.kw
  4. The entity will deliver receipt of the submitted request.

Note: If the application includes (The right to access (only)), a date will be set for the applicant to visit KDIPA headquarters to view the documents. In the event that the submitted application includes (Obtaining Documents), the fees prescribed by law Shall be applied in accordance with Article (4) of the Executive Regulations issued by Ministerial Resolution 62 of 2021.

  • Legal fees for The right to Obtain Documents:
  • (KWD 5.000) Five Kuwaiti Dinars for each document of which papers do not exceed (10) papers.
  • (0.500 fils) Five hundred fils for each additional paper.

Grievance/Appealing against the decision to reject the application for the right to access or to obtain documents:

Each individual whose application has been explicitly or implicitly rejected within the period prescribed by law, can submit a grievance to KDIPA in writing or electronically within (60) days from the date of their knowledge of refusal, or from the date of ending period specified by law for examining the application without a response; And a response to the grievance shall be answered within (60) days from the date of submission.

  4. The entity will deliver written receipt of the submission of grievance request.
  • Online Submission of Appeal:

  1. Fill out the approved form to for grievance online.
  2. Attach the supporting documents for the application
  3. Send the form via e-mail to RAI@Kdipa.gov.kw
  4. The entity will deliver online receipt of the submission of grievance request.
